Court Affirms Autopsy Photo Privacy

Without comment, the U. S. Supreme Court yesterday declined to hear an appeal filed by the Independent Florida Alligator. The appeal protested a Florida law sealing photographs taken at post-mortems.
The law was enacted by the Florida legislature very quickly following the death in 2001 of Dale Earnhardt Sr. in the last lap of the Daytona 500. Both the Orlando Sentinel and the Alligator sought access to the photos, reportedly not for publicaition, but to study in the hopes of improving motorsports safety.
Prior to the enactment of the new law, Florida had allowed public access to photographs of medical examiners’ autopsies with the intention of revealing incompetence or misdeeds by the examiners.
