Earnhardt Appeal Denied

Monday, word came down that (pictured here at Charlotte last weekend) Dale Earnhardt Jr’s appeal of his penalty for ‘use of improper language’ following Talladega was denied. The National Stock Car Racing Commission weighed the appeal and unanimously upheld the penalties. Following is the text of the release announcing the decision:


On October 18, 2004, the National Stock Car Racing Commission heard and considered the Appeal of Dale Earnhardt Incorporated. The Appeal concerned penalties issued by NASCAR under Section 12-4-A of the NASCAR Rule Book; actions detrimental to stock car racing; use of improper language. The penalties stemmed from the live broadcast of a NASCAR NEXTEL Cup Series event at Talladega Superspeedway on October 3, 2004.

The penalties assessed were:

  • Driver Dale Earnhardt Jr. - $10,000 fine; loss of 25 NASCAR NEXTEL Cup Series Championship Driver Points.
  • Car Owner Teresa Earnhardt
